Donation terms
By requesting deposit instructions or sending any donation to an address published or issued by LSS, you acknowledge and agree to these terms.

“LSS”, “the Foundation”, “we” and “us” mean the Local Solar System Foundation, the name under which [entity: Local Solar System DAO LLC (in formation)] operates. [LAWYER: final entity details and use of the “Foundation” name.]
By requesting deposit instructions or sending any donation to an address published or issued by LSS, you acknowledge and agree that:

Voluntary gift. Your donation is a voluntary, unconditional and irrevocable gift. You receive no goods, services, tokens, membership, voting rights, equity, interest, returns or any other consideration in exchange.

Tax treatment. Donations may not be tax-deductible in your jurisdiction. Whether a donation, or the crypto-asset you donate, gives rise to any deduction, credit, exemption or tax liability depends on the laws of your jurisdiction and on your circumstances, and the treatment of crypto-assets (including stablecoins such as USDT) differs between jurisdictions. LSS makes no representation about the tax treatment of any donation and, unless it states otherwise in writing, does not issue tax receipts. You are solely responsible for determining and meeting any tax obligations and should seek advice from a qualified local adviser. [LAWYER]

Not an investment. A donation is not an investment, loan, deposit, security, crowdfunding offer or purchase of any digital asset. LSS sells no tokens.

Use of funds: the Treasury, no earmarking. All donations are pooled in the Treasury of LSS. You cannot direct your donation to a specific initiative. The Treasury may be used for any of the needs of the project as a whole and of its future expansions, including, without limitation, staff, contributors and contractors; suppliers and service providers; servers, hosting, domains and infrastructure; software, licences and subscriptions; equipment and materials; research, testing and prototypes; content production and translation; legal, compliance, audit, banking and administrative costs; and any other purpose decided under its governance rules. LSS may allocate and reallocate Treasury funds, in accordance with its governance rules, to any activity or expansion of the project, including any of its initiatives, without further notice to you.

Pre-screening and review. Our destination wallet is revealed only through our donation gateway, after the origin wallet you enter has passed sanctions screening, and every received donation is reviewed before it is accepted into the Treasury. Deposit instructions are valid only for the origin address you entered and for the stated period.

Right to refuse or hold. We may, at our sole discretion and without giving reasons, decline, hold or segregate any donation, including where your origin address, identity, jurisdiction or funds may be connected to sanctions, fraud, theft, ransomware, darknet markets, mixing services or other illicit activity; where funds come from an address other than the one you entered; where information we request is not provided; or where screening cannot be completed.

Handling of non-accepted funds. Non-accepted funds will not be returned automatically. They will be segregated and handled in accordance with applicable law and professional advice, which may include reporting to competent authorities, holding, or return only where lawful. Any return will be net of network fees.

Information requests. We do not ask for the amount of your donation or for a declaration in advance. When a received donation, alone or together with other donations from the same origin, reaches the review thresholds below, or whenever our review requires it, we may request identity and source-of-funds information and a signed declaration, and may hold your donation until we receive it.

Your representations. You represent and warrant that: (a) the funds are lawfully obtained and yours to give; (b) you are not a sanctioned person, not acting for one, and not located in or resident of a comprehensively sanctioned jurisdiction; (c) the origin address you enter is controlled by you or the donor you lawfully represent; (d) you are of legal age and capacity; (e) you are not donating to evade tax, conceal the origin of funds, or obtain any improper advantage.

Irreversible transactions and errors. Blockchain transactions cannot be reversed. We are not responsible for funds sent to a wrong or expired address, on an unsupported network, in an unsupported asset, or with insufficient fees; such funds may be lost permanently. Except as required by law or decided by us at our sole discretion, donations are non-refundable.

Volatility and issuer risk. Crypto-asset values fluctuate. Stablecoins depend on their issuers and may be frozen or lose their peg. We record donations at their value on the date of receipt using a published reference source.

Public ledger. Donations are listed on our Transparency page by amount, asset, date, transaction link and status, without personal data. Your sending address and transaction remain publicly visible on the blockchain.

No relationship created. Donating creates no partnership, joint venture, agency, employment, membership or fiduciary relationship with LSS or any of its members, Council members or contributors.

Transfer to future entities. LSS may transfer assets and the rights and obligations under these terms to a successor or affiliated non-profit entity (for example, a Swiss association or foundation) pursuing the same purposes.

Limitation of liability. To the maximum extent permitted by applicable law, LSS’s total liability in connection with any donation is limited to the amount of that donation actually accepted into the Treasury.

Review thresholds
These thresholds are suggestions pending counsel’s review. They are applied after a donation is received, to the total received from the same origin address over any 12 months, in US dollar equivalent at receipt. Nothing is asked up front. [LAWYER]
